Preamble

These Terms & Conditions (the “Terms”) govern access to and use of the Bobibets service, the subscription to premium plans, and the purchase of products in the store. They merge the terms of use and the terms of sale into a single document.

By creating an account, using the service, or placing an order, the user fully accepts these Terms.

Definitions

  • Service: all features offered on bobibets.com and app.bobibets.com.
  • Account: the personal space created by the User to access the Service.
  • User: any natural person holding an Account.
  • League: a private group of Users competing on a championship.
  • Points: virtual in-game units, with no monetary value and not convertible into money.
  • $BB: Bobibets virtual currency usable outside Leagues (cashback, purchases within the Service). 1 $BB equals 1 cent within the Store.
  • Subscription: a paid plan (Pro or Légende) unlocking advanced features.
  • Store: the online shop accessible from the app, offering customized physical products made to order.
  • Publisher: RedBoxStudio OÜ, the company that operates Bobibets (see Legal notice).

I. Terms of use

1. Purpose of the Service

Bobibets is a free social football prediction game played among friends. Users create or join private Leagues and predict the outcome of real football matches using virtual Points.

Points cannot be converted into money or exchanged for any good or service outside of the game. No cash winnings can result from using the Service. Bobibets is a social entertainment game built on community, leaderboards and friendship.

2. Access to the Service

Core features of Bobibets are free. Some advanced features are available through a paid Subscription (Pro or Légende), as described in Part II below.

The Publisher strives to keep the Service available at all times but does not guarantee uninterrupted access (maintenance, technical incidents, force majeure).

3. Registration and Account

Registration is open to anyone who agrees to these Terms. The User undertakes to:

  • provide accurate, current and complete information when creating the Account;
  • keep their password and credentials confidential;
  • notify the Publisher without delay of any unauthorized use of their Account (support@bobibets.com).

Each User may only hold one Account. Creating multiple accounts is prohibited.

4. Minimum age

The Service is reserved for individuals aged 15 years or older, in accordance with Article 8 of the GDPR as applied in France (digital consent). Children under 15 are not allowed to create an Account.

Minor Users aged 15 to 17 use the Service under the responsibility of their legal guardians.

5. User conduct

The User is prohibited from, in particular:

  • creating multiple Accounts or impersonating a third party;
  • using bots, automation scripts, scrapers or any automated means to interact with the Service;
  • exploiting a flaw, bug or vulnerability of the Service to obtain an undue advantage (Points, $BB, features);
  • publishing unlawful, hateful, harassing, defamatory or sexual content, or content infringing third-party rights (username, avatar, messages, League name);
  • reselling, exchanging, transferring or attempting to monetize Points, $BB, an Account or a Subscription for real money or any other economic benefit;
  • compromising the security, integrity or proper functioning of the Service.

6. Sanctions

In the event of a breach of these Terms, the Publisher may, depending on severity and proportionately:

  • issue a warning to the User;
  • cancel predictions or remove Points / $BB obtained in breach of the rules;
  • temporarily suspend Account access;
  • permanently close the Account, with no refund of any ongoing Subscription.

7. Intellectual property

Bobibets, its brand, logo, interface, source code, editorial content and database remain the exclusive property of RedBoxStudio OÜ and are protected by copyright and database rights.

The User retains all rights in the content they publish (username, avatar, League name, comments). The User grants the Publisher a free, non-exclusive licence to use, reproduce, adapt and display such content, for the duration necessary to operate the Service, solely for the purpose of running the Service.

8. Personal data

The processing of Users’ personal data is described in detail in the Privacy policy. To exercise their rights, Users may write to dpo@bobibets.com.

II. Terms of sale

9. Premium Subscriptions

Bobibets offers two paid Subscriptions: Pro and Légende. The associated features are described on the pricing pages of the Service.

  • Pricing: Pro at €4.99/month or €49.99/year incl. VAT; Légende at €14.99/month or €149.99/year incl. VAT. The annual plan is roughly equivalent to two months free compared with monthly.
  • Billing: monthly or yearly depending on the chosen plan, via Stripe, in EUR incl. VAT. Payment is taken on subscription and then on each renewal date of the period.
  • Auto-renewal: the Subscription is automatically renewed every month until cancellation.
  • Cancellation: the User can cancel at any time from their Account. Cancellation takes effect at the end of the period already paid for.
  • No pro-rata refund: no amount is refunded for the unused portion of the period after cancellation.
  • Price changes: any change in price is notified at least 30 days in advance; the User may then cancel free of charge before the change takes effect.

In accordance with Articles L221-28 1° and L221-28 13° of the French Consumer Code, a consumer User who subscribes and requests immediate access to the Subscription expressly waives their right of withdrawal for the period already performed.

10. Store

The Store sells physical products (apparel, accessories) made to order by a print-on-demand provider (POD — Printful in the current version). No stock is held by the Publisher.

  • Prices: shown in EUR incl. VAT on product pages. Shipping costs are computed and shown at checkout, based on the delivery address.
  • Payment: Stripe, in EUR only, by card or any other method offered at checkout.
  • Confirmation: the order is confirmed by email after successful payment.
  • Availability: the Publisher may remove a product from the catalogue at any time; orders already confirmed are honoured as far as possible.

11. $BB cashback

At Store checkout, the User may apply part of their $BB balance as a discount on the cart amount. The following rules apply:

  • Conversion: 1 $BB = €0.01 (server-side parameter).
  • Cap: the $BB discount is capped at 30% of the cart amount (server-side parameter, recomputed at every step for security).
  • $BB cannot be converted into real money and cannot be refunded as cash.
  • In the event of a full or partial refund, the $BB used may be re-credited pro rata to the User’s Account.

12. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, EU consumers benefit from a period of 14 days from receipt of the product to exercise their right of withdrawal, without having to give reasons.

Exclusion — personalized products. Pursuant to Article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalized. Store products being printed on demand after each order, they fall under this exclusion. This information is reminded at checkout before validation.

Where withdrawal is available (non-personalized products), it is exercised by email to support@bobibets.com; return shipping costs are borne by the consumer. Refunds are issued within 14 days of recovery of the goods.

13. Delivery

Products are shipped from the POD provider’s printing centres (Latvia, Spain or the United Kingdom depending on the product). Indicative timeframes:

  • Production: 2 to 5 business days;
  • European Union delivery: 5 to 10 business days after dispatch;
  • Outside the EU: varies by destination, shown at checkout.

Any significant delay is communicated to the User. If a delivery cannot be completed, a re-shipment or a full refund is offered.

14. Legal warranty

Products bought from the Store benefit from:

  • the legal warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) for 2 years from delivery;
  • the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code) for 2 years from discovery of the defect.

15. Refunds

In case of a defective, non-conforming or undelivered product, the User has 30 days from receipt (or from the announced delivery date) to contact support@bobibets.com. Depending on the situation, the Publisher will offer a free re-shipment, a full refund via Stripe, or a store credit of equivalent value. $BB used are re-credited pro rata.

III. Common provisions

16. Changes to the Terms

The Publisher reserves the right to amend these Terms to adapt to changes in the Service or in regulations. Any material change is notified to the User by email or in-app banner at least 7 days before entry into force. Minor changes (wording, layout, corrections) may take effect without prior notice. Refusal of the new Terms triggers immediate termination of the Account and of any Subscription.

17. Termination

The User can close their Account at any time from their personal area. The Publisher may terminate or suspend an Account in the event of a serious or repeated breach of these Terms, subject to prior notice where possible.

18. Liability

The Service is provided “as is” and “as available”. The Publisher does not guarantee sporting performance, the accuracy of displayed odds (sourced from third parties), or the outcome of any prediction.

To the extent permitted by law, the Publisher’s liability is limited to direct, foreseeable damages reasonably attributable to a contractual breach. Mandatory consumer-protection rules remain applicable.

19. Force majeure

Neither party is liable for non-performance resulting from a case of force majeure within the meaning of Article 1218 of the French Civil Code or applicable case law (third-party infrastructure failure, major network outage, armed conflict, pandemic, public authority decision, etc.).

20. Dispute resolution

In the event of a dispute, the User is invited to first contact the Publisher at legal@bobibets.com to seek an amicable resolution.

Failing amicable resolution, consumer Users may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

21. Governing law and jurisdiction

These Terms are governed by Estonian law, the place of the Publisher’s seat.

In accordance with Regulation (EC) No 593/2008 (Rome I), consumers residing in France additionally benefit from the mandatory provisions of French consumer law and may bring proceedings before the French courts of their domicile.
